A federal grand jury in St. Louis Thursday indicted the former owner of the Sears Authorized Hometown Stores in Salem, Rolla and Washington, Demea Loyd of Salem, on five felony counts of wire fraud.  The press release from the U.S. Attorney’s office on this matter stated the case was investigated by the Federal Bureau of Investigation and the Rolla and Washington, Missouri Police Departments. Assistant United States Attorney John Ware is handling the case for the U.S. Attorney’s Office. The indictment states that between April 2013 and December 2014, Loyd embezzled approximately $400,000 from Sears, by making unauthorized withdrawals from a holding account and falsifying the monthly statements to hide the missing funds in the Rolla and Washington stores. If convicted, each count of wire fraud carries a maximum penalty of twenty years in prison and/or fines up to $250,000. In determining the actual sentences, a judge is required to consider the U.S. Sentencing Guidelines, which provide recommended sentencing ranges. The indictment alleges that Loyd, who owned two stores in Washington and Rolla, entered into a contract with Sears Authorized Hometown Stores, LLC, to exclusively distribute Sears merchandise from these two stores. The agreement states that Loyd would distribute Sears merchandise on a consignment basis and that the merchandise would remain Sears’ property until ownership was transferred to a customer. In exchange, Loyd was paid a commission based on the amount of sales. Loyd was to deposit all proceeds from each store into a “holding” account until they could be transferred to Sears. There was no evidence presented that indicated the store in Salem was a part of the fraud. As is always the case, charges set forth in an indictment are merely accusations and do not constitute proof of guilt. Every defendant is presumed to be innocent unless and until proven guilty.

The Salem Police Department released their report for the month of January. During the month, they wrote one equipment repair order, 14 summons to appear in court, 47 warning tickets, and 19 traffic tickets. The Salem Police Department investigated one report of abuse of a child, 13 accidents, three assaults, one burglary, one report of disorderly conduct, one report of domestic assault, seven reports of domestic violence, two reports of driving while intoxicated, four reports of driving while revoked and/or suspended, one report of felonious restraint, one report of filing a false report, one report of harassment, and one report of leaving the scene of an accident. The department also investigated one report of property damage, one report of stalking, and 11 reports of stealing. They also investigated one report of distributing/delivering/manufacturing/producing or possessing of a controlled substance, three reports of possession of marijuana, three reports of possession of drug paraphernalia and one report of possession of synthetic drugs. The Salem Police Department also conducted one death investigation. The police department received 1,101 calls for service during the month, handled 107 walk-ins to the station, and redirected 31 calls to the animal control officer. They spent 18 hours in court testifying, and four hours as court bailiff. The Salem Police Department drove a total of 9,129 miles and arrested 19 males and 17 females all during the month of January.

An accident occurred on Saturday February 6th at 11:10 in the morning in Phelps County on Highway 63 about three miles South of Rolla. According to the highway patrol report, a 2004 BMW 325 driven by an unknown driver exited a driveway and into the path of a 2012 Dodge Ram driven by 26 year-old Robin Kinder of Licking. Both vehicles were totaled and towed by C&C Towing. Kinder suffered minor injuries and was transported to the Phelps County Regional Medical Center.

The Missouri State Highway Patrol would like to remind the public that driver examination stations throughout the state will be closed on the following dates: Friday, February 12th in observance of Lincoln’s birthday, and Monday, February 15th in observance of Washington’s Birthday. Normal operations will resume on Tuesday, February 16th.

The Salem Boys Basketball Tigers connected for eleven 3-pointers through three quarters of play Friday night and played a strong defensive game en route to a 63-30 route of the Ava Bears in SCA Conference play. Kobe Mead led all Salem scorers with 20 points while Logan Woolf finished with 16 points and Jakob Happel added 11 more. Salem is 10-10 on the year, 2-1 in the SCA Conference and they will be in Houston Tuesday for another SCA Conference game.

The Salem Lady Basketball Tigers will play tonight against the Cuba Lady Wildcats in a non- conference game starting at 6:00 with the JV game with the varsity game to follow. Salem's record is 17-3 on the season and 5-0 in the SCA. You can hear the game on KSMO Radio and online at ksmoradio.com.

Jori Lehtera had a goal and an assist, and Brian Elliott made 38 saves as the St. Louis Blues beat the Minnesota Wild 4-1 on Saturday night. Vladimir Tarasenko, Paul Stastny and Troy Brouwer also scored for the Blues, who got their first regulation win in four tries against the Wild and improved to 8-3-1 in their last 12 at home. Elliott improved to 7-3-2 since taking over for the injured Jake Allen (lower body), including making 23 saves in the second period. The Blues will host the Winnipeg Jets Tuesday night on KSMO. The game will have a delayed start of 9:00 after Salem Tiger Basketball.

Riley Norris made three 3-pointers and scored 18 points to help Alabama beat Missouri 80-71 on Saturday. Freshman Kevin Puryear scored a season-best 22 points to lead Missouri who fell to 8-15 on the year and 1-9 in the SEC Conference. Senior Ryan Rosburg also set a career-high with 17 points and the duo combined for 13 boards. Missouri will be back in action Wednesday night at 7:30 when they host Vanderbilt.

Super Bowl MVP Von Miller forced two fumbles to set up Denver's two touchdowns and the Broncos defense frustrated Cam Newton all game to carry Peyton Manning to his second Super Bowl title with a 24-10 victory over the Carolina Panthers on Sunday.
