The City of Salem has begun the necessary steps in order to get a clear title to the Old Middle School Property at 10th and Hickory Streets in Salem as City Attorney William Camm Seay last week filed a civil suit against the Western Cherokee. Since there have been two claimants to the property in the last year, the city is looking for a court ordered deed to ensure a clean title to the property which would be necessary for the city to have before the cleanup of the property can be initiated. The action to file the civil suit was approved by the aldermen in closed session at their July 18th meeting. The Western Cherokee has 45 days to file an answer or appear and defend an action to retain title, or a default judgment will be entered against them according to the petition. Early this year, Tim Spencer representing the Western Cherokee submitted a letter to the alderman through the city attorney at the time, Nanci Wisdom, to return the property to the city. The city deeded the property to the Western Cherokee in 2004 with a Special Warranty Deed that included the stipulation that the Western Cherokee restore, improve and perform constant maintenance of the property. The city notified the Western Cherokee last July of their failure to uphold the covenants of the deed, giving the Western Cherokee one year to correct the situation, but little repair work or improvements have been made to the property at all.
