The City of Salem Board of Aldermen held their regular meeting Monday evening at the city hall council chambers. Libby Sanders representing the Board of the Bonebrake-McMurtrey Foundation, Ltd.  read a statement giving the foundations position on the city crossing their land to make improvements to the sewer without easements. The statement said that in 1999, sewer improvements and repairs led to massive damages to the property and no solution has yet been reached between the city and foundation, and this too occurred without easements. The statement indicates that the foundation is not against sewer improvements, but will not allow the city to access the property without a settlement for the damages from 1999, and easements. Laurie Walker from 712 North Pershing then discussed with the board the living conditions that a neighboring German shepherd has and the odors that come from the property due to the lack of the cleaning up after the dog. She also indicates that the dog is often left without water and food, and is caged constantly, has a possible infection and is never let out. She feels that as many as nine violations of the city ordinances are occurring with this animal and the property. She seemed to back up her story with a notebook full of pictures although city animal control office Rick Raw said that these people aren’t violating any city ordinances when he is there. The aldermen appeared appalled at the pictures she submitted that showed the dog and the conditions it lives in, and although no vote was taken, the mayor asked to keep the book. After the consent agenda was approved that showed the sales tax increasing slightly in June, Alderman Jim McDaniels wants to have all the brush and branches around the town and city park be pickup up promptly. He also asked that the ditches in the city park, the roadside park on Highway 19 and behind the 4^th Street Mall be weeded as well as the at the electric department shed. Alderman Nash brought up the continued problem of the lights being left on at the tennis courts at the city park and at the Al Brown Field. The mayor said they are waiting on a man from MUSCO who installed the lights to come down and check out the damage to the lights at Al Brown on the old baseball field, and figure out a remote control timer or switch to control the lights, but the alderman are growing impatient waiting for this man. Mayor Brown said that Pierce Asphalting from Rolla and Cuba will be in town to measure Hawkins, Dale and Beasley Streets to see if he has enough oil to do those streets now. The mayor said that the price for asphalting all the streets the city planned to do has increased from $240,000 to $314,300, so the city may rent a sealing machine to extend the life of some of the streets. Brown said that tree trimming is going to be done this week around the three-phase lines on Center Street and Carty Street and traffic should avoid those areas while the trimming is going on. He said that five headstones were turned over in the Cedar Grove Cemetery Friday night and the matter has been turned over to the police. He stated that 54 people attended the recycling day on Saturday and he is applying for a grant to get a recycling trailer for Salem as well as to pay for labor to work the trailer. The board approved Bill 3137 updating the ordinance for flood damage prevention so that the citizens of Salem can get flood insurance. They also approved Bill 3138 that extends the contract with Waste Corporation for the pickup of residential and commercial waste for the next three years with no increase in cost next year. The board then approved numerous budget adjustments to the 2007-2008 fiscal year budget from a collection of city funds, and approved a policy change on work orders that allows owners to write a letter to the city to have work done on their property if they have to be out of town or unavailable. The board hard from Jeff Meadows from Archer Engineering about the schedule of compliance required by the Department of Natural Resources and the EPA on a CMOM plan for stormwater infiltration in the city’s sanitary lines. By October, the city has to submit a plan and by August of 2009, the plan has to be in place or the city could be faced with state and federal mandates. Meadows explained the procedure focusing on only one of the city’s watersheds in the Franklin Avenue and Route J area at first and getting an accurate map of the manholes and sewer lines using GPS, do flow monitoring during dry and rainy conditions, do data comparisons, and create a hydraulic model of the system. The board will have to vote on the work at the next meeting. The board then approved the mayor and city clerk attending the Missouri Municipal league meetings September 7^th through the 11th in Springfield at a cost of $185 each. After the bills were approved, the board went into closed session.

Dent County Coroner Eddie Wilson released a report that 38-year old Vance Davis Marago became unresponsive Friday night while exercising at his brother’s residence. There was no previous medical history or no known medications, and family members present witnessed the incident. Dr. Berman of the Salem Memorial District Hospital pronounced Marago dead at 11:06 Friday evening. Dr. Eddie Adelstein at the University Missouri Pathology Department in Columbia performed an autopsy on Saturday, July 19^th.  The Dent County Sheriff’s Department and the Missouri State Highway Patrol were in charge of the investigation. The body was released to the James & Gahr Mortuary.

Bill Hall started a three-run rally in the 10th inning with a home run after the Cardinals tied the game in the bottom of the 9th inning, and Milwaukee pulled out a 6-3 win over St. Louis. Troy Glaus doubled twice with two RBI and Skip Schumaker was 2-for-3 with an RBI and a walk for the Cardinals. The two teams play tonight at 7:05 and you can hear the game on KSMO.

St. Louis Cardinals have recalled pitcher Mitchell Boggs from Memphis (PCL); optioned pitcher Jaime Garcia to Memphis.

Miguel Cabrera had a 5-for-6 game with six runs driven in and two scored as the Detroit Tigers destroyed the Kansas City Royals, 19-4, at Kauffman Stadium. Luke Hochevar (6-8) was tagged with the loss for giving up seven runs on eight hits in five innings of work for the Royals, who had won five of seven coming into the game. Billy Butler hit a two-run single in the loss. The two teams play tonight.
