On Friday afternoon, Missouri State Attorney General Chris Koster filed a Petition in Quo Warranto against Dent County Prosecuting Attorney Jessica Sparks to have her removed from office. According to the petition, Sparks has failed to file or prosecute 253 felony cases, because she feels the Dent County Commissioners would not accommodate her demands for additional budgetary items for her office. The petition states that Sparks failure to perform her known duties has resulted in crime victims suffering needless and unreasonable anxiety and emotional distress; and she has failed to notify victims of the status or final decisions on cases and failed to forward the victims of crimes the restitution payments that have been received by her office for victim’s benefits. The petition also states that Sparks has appeared in court unprepared to represent the State of Missouri and cases have been dismissed, because she failed to fulfill her responsibilities to prepare jury instructions for criminal cases. The petition states that Sparks has misused her office to falsely accuse law enforcement officers, including the Salem Chief of Police and members of the highway patrol of acts of misconduct and physical violence. The petitions says that Sparks willful violation and neglect of her official duties and failures to perform official acts or duties required of her could result in her forfeiture of the office of Prosecuting Attorney of Dent County. Sparks has within 10 days to answer to these allegations in the Petition Quo Warranto, otherwise a judgment by default may be taken against her and she will be removed from office.  Circuit Court Judge Camm Seay is waiting on approval from the state to appoint a temporary prosecuting attorney. If Sparks is removed from office, the Governor would appoint a prosecuting attorney to carry out the reminder of Sparks’ elected term
